Tariff-Rate Quota Changes for Washing Machines, Solar Panels to be Effective Feb. 7

U.S. Customs and Border Protection reports that as of Feb. 7 the Section 201 safeguard tariff-rate quotas imposed in 2018 on imports of large residential washing machines (and parts thereof) and crystal silicon photovoltaic cells (and modules of CSPV cells) will be revised as follows.

Washing Machines

- the tariff on the first 1.2 million washing machines will fall from 20 percent to 18 percent

- the tariff on over-quota imports of washing machines will fall from 50 percent to 45 percent

- the in-quota amount of washing machine parts will increase from 50,000 to 70,000 units

- the tariff on over-quota washing machine parts will fall from 50 percent to 45 percent

CSPV Cells and Modules

- the in-quota amount of CSPV cells will remain 2.5 gigawatts

- the tariff on over-quota CSPV cells will fall from 30 percent to 25 percent

- the additional tariff on CSPV modules will fall from 30 percent to 25 percent

For both washing machines and CSPV cells, entries of in-quota goods should use entry type code 02, 06, 07, 12, 23, 32, 38, or 52 and entries of over-quota goods should use a non-quota entry type; e.g., entry type 01.

In addition, along with the appropriate classification in HTSUS Chapter 84 (washing machines) or Chapter 85 (CSPV cells), importers should report the following HTSUS numbers.

9903.45.01 – in-quota for washing machines (low rate)

9903.45.02 – over-quota for washing machines (high rate)

9903.45.05 – in-quota for washing machine parts (low rate)

9903.45.06 – over-quota for washing machine parts (high rate)

9903.45.21 – in-quota for CSPV cells (low rate)

9903.45.22 – over-quota for CSPV cells (high rate)

9903.45.25 – additional duty for CSPV modules

Covered goods from all countries except for the following are covered by these TRQs: Afghanistan, Albania, Algeria, Angola, Armenia, Azerbaijan, Belize, Benin, Bhutan, Bolivia, Bosnia and Herzegovina, Botswana, Brazil, Burkina Faso, Burma, Burundi, Cambodia, Cameroon, Cape Verde, Central African Republic, Chad, Comoros, Congo (Brazzaville), Congo (Kinshasa), Côte d'Ivoire, Djibouti, Dominica, Ecuador, Egypt, Eritrea, Ethiopia, Fiji, Gabon, The Gambia, Georgia, Ghana, Grenada, Guinea, Guinea-Bissau, Guyana, Haiti, India, Indonesia,  Iraq, Jamaica, Jordan, Kazakhstan, Kenya, Kiribati, Kosovo, Kyrgyzstan, Lebanon, Lesotho, Liberia, Macedonia, Madagascar, Malawi, Maldives, Mali, Mauritania, Mauritius, Moldova, Mongolia, Montenegro, Mozambique, Namibia, Nepal, Niger, Nigeria, Pakistan, Papua New Guinea, Paraguay, Rwanda, Saint Lucia, St. Vincent and the Grenadines, Samoa, Sao Tomé and Principe, Senegal, Serbia, Sierra Leone, Solomon Island, Somalia, South Africa, South Sudan, Sri Lanka, Suriname, Swaziland, Tanzania, Timor-Leste, Togo, Tonga, Tunisia, Turkey, Tuvalu, Uganda, Ukraine, Uzbekistan, Vanuatu, Yemen, Zambia, and Zimbabwe.

Washing machines and parts thereof from Canada and the Philippines are excluded from these TRQs as well.
