CPSC Withdraws Rule Exempting Trunk Wood in Toys from Heavy Metal Testing

The Consumer Product Safety Commission has withdrawn a direct final rule determining that unfinished and untreated trunk wood does not contain heavy elements that would exceed the limits specified in the Commission’s mandatory toy safety standard, ASTM F963-11. The CPSC received significant adverse comments on this rule, which it states will be addressed in a forthcoming final rule based on a proposed rule issued concurrently with the direct final rule. As a result, a regulatory change under which unfinished and untreated trunk wood in toys would not require third-party testing for the heavy element limits in the toy safety standard will not take effect Sept. 15.
