IPR Enforcement: Storage Tapes, Electronic Devices, Road Milling Machines, Digital Cameras

Data Storage Tapes. In investigation 337-TA-1012 the International Trade Commission has determined that the importation, sale for importation, and sale within the U.S. after importation of magnetic data storage tapes and cartridges containing the same are violating some, but not all, of the patents asserted by Fujifilm Corporation and Fujifilm Recording Media U.S.A. Inc. The ITC has determined that the appropriate remedy is a limited exclusion order against infringing products and a cease and desist order against each of the respondents. However, the ITC has determined to exempt from these orders subject goods that are imported or used for the purpose of supporting warranty, service, repair, and compliance verification obligations. Infringing goods may continue to enter the U.S. during the 60-day presidential review period under a zero bond.

Electronic Devices. The ITC has terminated patent infringement investigation 337-TA-1072 of Wi-Fi enabled electronic devices and components thereof without the imposition of import restrictions based on the withdrawal of the allegations by complainants Sharp Corporation and Sharp Electronics Corporation.

Recombinant Factor IX Products. The ITC has terminated patent infringement investigation 337-TA-1066 of recombinant factor IX products without the imposition of import restrictions based on the withdrawal of the complainant by Biovertativ Inc., Bioverativ Therapeutics Inc., and Bioverativ U.S. LLC.

Road Milling Machines. The ITC has terminated patent infringement investigation 337-TA-1067 of road milling machines and components thereof with respect to numerous patent claims that have been withdrawn by complainant Wirtgen America Inc.

Digital Cameras. The ITC has terminated patent infringement investigation 337-TA-1059 of digital cameras, software, and components thereof with respect to numerous patent claims asserted by complainants Carl Zeiss AG and ASML Netherlands B.V.
