Revocation, Modification of CBP Classification Rulings

The following final revocations and modifications of U.S. Customs and Border Protection rulings are included in the Aug. 16, 2017, Customs Bulletin and Decisions and will be effective for goods entered or withdrawn from warehouse for consumption on or after Oct. 16.

Glass Plant Watering Bulbs. CBP is reclassifying glass plant watering bulbs as glassware of a kind used for indoor decoration or similar purposes under HTSUS 7013.99 rather than as other articles of glass under HTSUS 7020.00.60 (5 percent duty). CBP explains that the function of these items is similar to that of decorative glass vases or pitchers. CBP is also excluding these items from classification as equipment for horticultural purposes under HTSUS 9817.00.50 (duty-free). Ruling HQ H258963 is revoking ruling NY N020311 to reflect this change.

Fertilizer. CBP is reclassifying Chelal Fe, an aqueous solution used as a fertilizer, as oxygen-function amino compounds under HTSUS 2922.49.80 (3.7 percent duty) rather than as other organic compounds under HTSUS 2942.00.5000 (3.7 percent). Ruling HQ H265102 is revoking rulings NY A88070 and NY A87653 and modifying ruling NY H86531 to reflect this change.

Fragrance Component. CBP is reclassifying a fragrance component, musk 50/DEP/BB/IPM (chemical name 1,3,4,6,7,8-hexamethyl-cyclopenta(G)-2-benzopyran), as a mixture with a basis of one or more odoriferous substances, of a kind used in industry, under HTSUS 3302.90.1050 (duty-free) rather than as a heterocyclic compound with oxygen hetero-atoms only under HTSUS 2932.99.7000 (3 cents/kg + 14.3 percent duty). CBP explains that because this substance is a mixture consisting of an odoriferous substance and diluents, and because it is used as a raw material for perfumery products, it is described by Explanatory Note 33.02 as an example of a product classifiable in heading 3302. Ruling HQ H280915 is modifying ruling NY 818805 to reflect this change.

Electrical Cables. CBP is reclassifying certain electrical cables used in patient monitoring cable assemblies and certain wiring harnesses as other electrical conductors under HTSUS 8544.42.90 (duty-free) rather than as coaxial cable under HTSUS 8544.20.00 (5.3 percent duty). Ruling HQ H127136 is modifying ruling HQ W967779 and revoking ruling HQ 961830 to reflect this change.
