IPR Import Restrictions Imposed on Personal Transporters

In patent and trademark infringement investigations 337-TA-1007 and -1021 the International Trade Commission has imposed a limited exclusion order prohibiting the importation of (a) SWAGWAY-branded personal transporters, components thereof, and packaging and manuals thereof manufactured outside the U.S. that infringe one or more of two trademarks asserted by complainants Segway Inc., DEKA Products Limited Partnership, and Ninebot (Tianjin) Technology Co. Ltd. and (b) personal transporters, components thereof, and packaging and manuals therefor manufactured outside the U.S. that infringe one or more of those trademarks that cover the “SEGWAY” marks and that are manufactured or imported by or on behalf of respondent Segaway. The ITC has also issued a cease and desist order directed against Swagway.

Further, the ITC has determined to set at zero and 100 percent of entered value, respectively, the bond amounts under which infringing goods from Swagway and Segaway may continue to enter the U.S. during the 60-day period the president has to review the ITC’s remedy.
