Redesigned Products Not Subject to IPR Import Restrictions, ITC Finds

In patent infringement investigation 337-TA-945 of network devices, related software, and components thereof, the International Trade Commission has found that complainant Cisco Systems Inc. has failed to show by a preponderance of the evidence that one of the respondent’s redesigned switches infringes specified patent claims or that the respondent has indirectly infringed those claims by contributing to or inducing infringement by its customers. As a result, the ITC has determined to modify its limited exclusion order and cease and desist order against that respondent to exempt the redesigned products.
