IPR Enforcement: Microperforated Packaging, Batteries, Test Instruments

Microperforated Packaging. The International Trade Commission has instituted investigation 337-TA-1127 to determine whether imports of microperforated packaging containing fresh produce are violating Section 337 of the 1930 Tariff Act by reason of patent infringement.

Complainant Windham Packaging LLC requests that after this investigation the ITC issue a limited exclusion order, which would direct U.S. Customs and Border Protection to prohibit the entry of infringing products into the U.S., and cease and desist orders, which would require the named respondents to cease actions that violate Section 337, including selling infringing imported articles out of U.S. inventory. The respondents in this investigation are located in the U.S.

Batteries. The ITC has terminated with respect to certain patent claims patent infringement investigation 337-TA-1087 of batteries and electrochemical devices containing composite separators, components thereof, and products containing the same.

Test and Measurement Instruments. The ITC has terminated patent infringement investigation 337-TA-1104 of multi-domain test and measurement instruments as to certain accused products based on consent orders between complainant Tektronix Inc. and the three respondents.
