AD/CV Case Update: Flanges, Citric Acid, Nails, Solar Cells

Flanges. The International Trade Administration has made final affirmative dumping determinations on finished carbon steel flanges from India and Italy and a final affirmative subsidy determination on such flanges from India. The ITA determined dumping margins of 11.32 percent to 12.58 percent for India and 79.17 percent to 204.53 percent for Italy as well as subsidy rates of 5.66 percent to 9.11 percent for India. The ITA will instruct U.S. Customs and Border Protection to collect AD and CV cash deposits on entries of subject goods at these rates.

Citric Acid. The ITA has initiated AD duty investigations of citric acid and certain citrate salts from Belgium, Colombia, and Thailand and a CV duty investigation of such goods from Thailand.

The scope of these investigations covers the following.

- all grades and granulation sizes of citric acid, sodium citrate, and potassium citrate in their unblended forms, whether dry or in solution, and regardless of packaging type

- blends of citric acid, sodium citrate, and potassium citrate, as well as blends with other ingredients, such as sugar, where the unblended form(s) constitute 40 percent or more, by weight, of the blend

- all forms of crude calcium citrate, including dicalcium citrate monohydrate, and tricalcium citrate tetrahydrate, which are intermediate products in the production of citric acid, sodium citrate, and potassium citrate

- the hydrous and anhydrous forms of citric acid, the dihydrate and anhydrous forms of sodium citrate (otherwise known as citric acid sodium salt), and the monohydrate and monopotassium forms of potassium citrate

Citric acid and sodium citrate are classifiable under HTSUS 2918.14.0000 and 2918.15.1000. Potassium citrate and crude calcium citrate are classifiable under HTSUS 2918.15.5000 and, if included in a mixture or blend, 3824.99.9295. Blends that include citric acid, sodium citrate, and potassium citrate are classifiable under HTSUS 3824.99.9295.

The scope does not include calcium citrate that satisfies the standards set forth in the United States Pharmacopeia and has been mixed with a functional excipient, such as dextrose or starch, that constitutes at least two percent, by weight, of the product.

Nails. In the preliminary results of its administrative review of the CV duty order on steel nails from Vietnam for the period Nov. 3, 2014, through Dec. 31, 2015, the ITA has determined a net subsidy rate of 313.97 percent for two producers/exporters. The ITA has also rescinded this review with respect to eight companies at the request of the petitioner.

Solar Cells. In the final results of its administrative review of the AD duty order on crystalline silicon photovoltaic cells, whether or not assembled into modules, from China for the period Dec. 1, 2014, through Nov. 30, 2015, the ITA has determined weighted average dumping margins of 4.66 percent to 13.07 percent. AD duties based on these rates will be assessed on entries of subject goods during the period of review, and AD cash deposits at these rates will be required for subject goods entered or withdrawn from warehouse for consumption on or after June 27.

The ITA also determined that seven companies had no shipments of subject goods to the U.S. during the period of review. These companies will maintain their AD duty rates from the most recent segment of this proceeding in which they participated.
