Classification Change Finalized for Evaporated Creamer
In the June 17, 2020, Customs Bulletin and Decisions, U.S. Customs and Border Protection reclassified evaporated creamer as other food preparations under HTSUS 1901.90.9195 (6.4 percent duty) rather than as dairy preparations containing over 10 percent by weight of milk solids under HTSUS 1901.90.6100 (16 percent duty). CBP explains that this creamer contains only 5.4 percent of non-fat milk solids.
Ruling HQ H305298 will revoke ruling NY N305031 to reflect this change, effective for goods entered or withdrawn from warehouse for consumption on or after Aug. 16.
