Background

The following proposed revocations and modifications of U.S. Customs and Border Protection rulings are included in the April 1, 2020, Customs Bulletin and Decisions. Comments on these proposed changes are due by May 1.

Classic Automobile

CBP is proposing to reclassify a 1937 Alfa Romeo automobile as a used automobile under HTSUS 8703.23.0190 (2.5 percent duty) rather than as a collectors’ piece of historical interest under HTSUS 9705.00.0085 (duty-free). CBP explains that this automobile was not owned or driven by a famous person and has no connection with a historic car race. CBP further states that merely being produced in a small quantity or being of a certain age is not sufficient to make an article eligible for classification in heading 9705. Rulings NY N278756 and NY N281521 would be revoked to reflect this change.

Steel Doctor Blades

CBP is proposing to reclassify doctor blades intended to be used as parts for printing presses that are made of various types of steel under HTSUS 7209.90.0000, 7211.90.0000, 7219.90.0060, or 7220.90.0060 (all duty-free) rather than under HTSUS 7210.90.9000, 7212.50.0000, 7212.90.00, or 7220.90.00 (all duty-free). CBP is proposing to modify ruling NY N301037 to reflect this change.

The steel in these items is cold-rolled in Sweden and shipped to Italy, where the edges are ground. The final product has a ceramic coating and is shipped from Italy to the U.S. Although stated to be custom-made, the blades are flat-rolled steel in 200 meter coils that are imported without markings indicating at what length the doctor blades need to be cut for printing press use.
