Classification of Steel Tube Fitting is Subject of CBP Inquiry

U.S. Customs and Border Protection has received a petition submitted on behalf of a domestic manufacturer of hydraulic connectors, fittings and adapters requesting the reclassification of a steel tube fitting from Taiwan. Comments on the correctness of the current classification are due no later than April 11.

In ruling NY E83408 CBP classified this fitting as other steel tube or pipe fittings under HTSUS subheading 7307.99.50 (4.3 percent duty), reasoning that the fitting is a part of general use that can connect tubes and pipes. The petitioner contends that the fitting should be classified as other hydraulic engine and motor parts under HTSUS subheading 8412.90.90 (duty-free) because it is solely imported, sold and specifically designed according to hydraulic system industry specifications for use in the assembly of particular hydraulic engine or motor systems. The petitioner asserts that some of its competitors are classifying all or a substantial portion of similar fittings under 8412.90.90, which puts it at a competitive disadvantage.
