IPR Enforcement Actions on Chassis Parts, Valve Actuation Devices, Wipers, Audio Processing Equipment
Chassis Parts. The International Trade Commission has instituted investigation 337-TA-978 to determine whether imports of chassis parts incorporating movable sockets and components thereof are violating Section 337 of the 1930 Tariff Act by reason of patent infringement. Complainant Federal-Mogul Motorparts Corporation requests that after this investigation the ITC issue a general or limited exclusion order, which would direct U.S. Customs and Border Protection to prohibit the entry of infringing products into the U.S., and a cease and desist order, which would require the named respondent to cease actions that violate Section 337, including selling infringing imported articles out of U.S. inventory. The respondent in this investigation is located in Canada.
Variable Valve Actuation Devices. At the request of complainant Jacobs Vehicle Systems Inc., the ITC has terminated patent infringement investigation 337-TA-954 of variable valve actuation devices and automobiles containing the same with respect to certain patent claims and one respondent.
Windshield Wipers. In patent infringement investigations 337-TA-928 and -937 of windshield wipers and components thereof, the ITC has determined to reverse in part and vacate in part a finding that the importation, sale for importation or sale within the U.S. after importation of such goods are violating certain patent claims asserted by complainants Valeo North America Inc. and Delmex de Juarez S. de R.L. de C.V. The ITC has remanded this investigation to the administrative law judge and directed the ALJ to issue a remand determination by Feb. 23, 2016.
Audio Processing Hardware and Software. The ITC has terminated two respondents from patent infringement investigation 337-TA-949 of audio processing hardware and software and products containing same on the basis of a settlement agreement and patent technology and license agreement with complainant Andrea Electronics Corp.
