IPR Import Restrictions Imposed on Aerogel Insulation Materials
In investigation 337-TA-1003 the International Trade Commission has determined that the importation, sale for importation, and sale within the U.S. after importation of composite aerogel insulation materials and methods for manufacturing the same are violating patents asserted by Aspen Aerogels Inc. As a result, the ITC has issued a limited exclusion order prohibiting the unlicensed entry of infringing goods that are imported or manufactured abroad by or on behalf of the respondents or any of their affiliated companies, parents, subsidiaries, or other related business entities, or their successors or assigns. During the 60-day period the president has to review this remedy infringing goods may continue to enter the U.S. with the posting of a bond of 100 percent of the entered value.
