CBP Guidance on Participating in ACE Pilot Test of FWS-Regulated Goods
As of May 23 U.S. Customs and Border Protection modified and reopened its test of the submission of certain import data and documents for commodities regulated by the Fish and Wildlife Service through the Automated Commercial Environment. CBP has provided the following guidance for those participating in this pilot.
Initial Filings. The initial filings for each participating filer will involve a technical trace in the production environment. This call will include FWS personnel at the port and headquarters level, the FWS technical team, the filer’s operational and technical people (or ABI vendor), CBP personnel with the ACE PGA technical team, CBP client representatives, and CBP port personnel. The filer will provide specific information for the initial filings to include the commodity, port of unlading, port of entry, carrier name, bill of lading or air waybill number, and ETA at the port. Following the technical trace call, FWS must approve that a filer can begin the pilot and continue to file in production.
Data Requirements. Once a filer is participating in the pilot, all entries for ACE cargo release that include a tariff number flagged for FWS data must be filed with either (a) the full ACE PGA FWS message set or (b) one of two disclaimer codes based on the alternate filing method selected (click here for more details on these methods). CBP therefore recommends that filers limit the port codes they choose for filing to provide the least disruption to other testing they may be doing that is unrelated to FWS testing.
Review. FWS and CBP will review the results of the pilot 90 days after its beginning before deciding whether to extend it.
