Sandler, Travis & Rosenberg Trade Report

The International Trade Commission has terminated without the imposition of import restrictions investigation 337-TA-947 of light-emitting diode products and components thereof. Complainant Cree Inc. had alleged that the importation, sale for importation, and sale for importation of such goods were violating Section 337 of the 1930 Tariff Act by reason of patent infringement and false and misleading advertising. The presiding administrative law judge found a violation by the respondents, which are located in the U.S. and China, but they subsequently reached a settlement and license agreement with Cree.
