Sandler, Travis & Rosenberg Trade Report

The International Trade Commission has remanded patent infringement investigation 337-TA-613 of certain 3G mobile handsets and components thereof for a determination concerning infringement, affirmative defense and public interest issues. The Court of Appeals for the Federal Circuit sent this case back to the ITC for further proceedings after reversing its determination that the subject goods were not infringing patents owned by InterDigital Communications Corp. and InterDigital Technology Corp.

The ITC has also terminated patent infringement investigation 337-TA-862 of certain electronic devices, including wireless communication devices, tablet computers, media players and components thereof, based on a settlement agreement between complainants Ericsson Inc. and Telefonaktiebolaget LM Ericsson and the respondents. As a result, no IPR-related import restrictions will be imposed on the subject articles.
