EPA Mulling Reporting Requirements for PFAS Chemicals
The Environmental Protection Agency will soon seek public input on potentially adding certain per- and polyfluoroalkyl substances (PFAS) to the list of chemicals companies are required to report to the agency as part of the Toxics Release Inventory. The EPA notes that this action supports its February 2019 PFAS Action Plan, which describes the agency’s long- and short-term actions to address PFAS.
Input may be provided on which, if any, PFAS should be evaluated for listing, how to list them, and what would be appropriate reporting thresholds given their persistence and bioaccumulation potential. The EPA is also seeking any additional data to inform its evaluation and determination of which PFAS may meet the criteria of section 313 of the Emergency Planning and Community Right-to-Know Act. Interested parties will have 60 days from the date the EPA notice is published in the Federal Register to submit any input.
The EPA will use the comments received to determine whether data and information are available to fulfill the TRI chemical listing criteria, as well as to help evaluate the extent and usefulness of the data that would be gathered under TRI.
