House May Consider MTB as Early as July 21; Energy and Commerce Committee to Mark Up Registered Agent Bill
The House of Representatives could consider as early as July 21 a miscellaneous trade bill providing duty breaks for hundreds of imported inputs and other goods not produced or otherwise available domestically. The U.S. Manufacturing Enhancement Act of 2010 (H.R. 4380) is slated to be considered under suspension of the rules, which requires a two-thirds vote in favor. The MTB process has been held up by a self-imposed ban by House Republicans on legislation with earmarks but H.R. 4380 will require significant Republican support to secure the required two-thirds majority.

Separately, the House Energy and Commerce Committee has announced its intention to mark up legislation on July 21 that would require foreign manufacturers of consumer goods to establish registered U.S. agents who are authorized to accept service of process on behalf of the manufacturer in all civil and regulatory actions in state and federal courts. The legislation was marked up June 30 by the Energy and Commerce Committee’s Subcommittee on Commerce, Trade and Consumer Protection and could be further amended by the full committee. A July 14 letter from the National Customs Brokers and Forwarders Association of America indicated that “there is revised language under discussion” that would modify this bill by requiring importers to submit a declaration attesting to their belief that the foreign manufacturer has complied with the registered agent requirement (see July 19 issue of WorldTrade\INTERACTIVE for additional details).
