Sandler, Travis & Rosenberg Trade Report

In patent infringement investigation 337-TA-965 of table saws incorporating active injury mitigation technology and components thereof, the International Trade Commission has granted a motion for summary determination that complainants SawStop LLC and SD3 LLC satisfied the economic prong of the domestic industry requirement.

The products at issue in this investigation are table saws that quickly stop and/or retract the cutting blade to prevent serious injury when detecting that the operator has made contact with the blade. The complainants have requested that the ITC issue a limited exclusion order, which would direct U.S. Customs and Border Protection to prohibit the entry of infringing products into the U.S., and cease and desist orders, which would require the named respondents to cease actions that violate Section 337, including selling infringing imported articles out of U.S. inventory.
