Sandler, Travis & Rosenberg Trade Report

In patent and copyright infringement investigation 337-TA-935, the International Trade Commission has determined to issue (1) a general exclusion order barring the unlicensed entry of personal transporters that infringe one patent asserted by complainants Segway Inc. and DEKA Products Limited Partnership, (2) a limited exclusion order prohibiting the unlicensed entry of infringing personal transporters, components thereof and manuals therefor manufactured abroad by or on behalf of certain respondents that are covered by one or more asserted patents and copyright, and (3) a cease and desist order against one domestic defaulting respondent.

The ITC has also determined that a bond in the amount of 100 percent of the entered value is required to permit temporary importation of these articles during the 60-day period the president has to review this remedy.
