ITC to Probe Whether New Kinesiotherapy Devices are Subject to Import Exclusion Orders

The International Trade Commission has instituted an advisory opinion proceeding to determine whether new kinesiotherapy devices from one of the respondents in the ITC’s patent infringement investigation of such items are covered by the general exclusion order or the cease and desist order the ITC issued against this respondent in June 2013. Those orders followed the ITC’s determination that the importation, sale for importation and sale within the U.S. after importation of these devices were violating certain patents owned by Standard Innovation Corporation of Canada and Standard Innovation (US) Corp. The ITC’s Office of Unfair Import Investigations will conduct this proceeding and report back by May 14, and the ITC will issue an advisory opinion by June 30.
