Food Safety Rules’ Compliance Dates Extended Up to Two Years

The Food and Drug Administration is extending the dates for compliance with certain provisions in regulations implementing the Food Safety Modernization Act with respect to foreign supplier verification programs, preventive controls for human and animal food, and produce safety. These changes include providing more time for manufacturers to meet requirements related to certain assurances that their customers must provide, more time for importers of food contact substances, and other extensions to align compliance dates for various other food operations or provide time for the FDA to resolve specified issues.

- The compliance dates for certain related provisions in all four rules concerning customer assurances when controls are applied downstream in the distribution chain are being extended for two years (original dates ranged from Sept. 19, 2016, to Jan. 27, 2020; new dates range from Sept. 19, 2018, to Jan. 26, 2022).

 - The compliance dates for 21 CFR parts 117 and 507 (current good manufacturing practices, hazard analysis and risk-based preventive controls for human and animal food, respectively) for facilities solely engaged in packing and/or holding activities conducted on raw agricultural commodities that are produce and/or nut hulls and shells, and for certain facilities that would qualify as secondary activities farms except for the ownership of the facility, are being extended by approximately 16 months (original dates ranged from Sept. 19, 2016, to Sept. 17, 2019; new dates range from Jan. 26, 2018, to Jan. 26, 2021)

- The compliance dates for 21 CFR part 117 for facilities that would qualify as farms if they did not color raw agricultural commodities are being extended by approximately 16 months (original dates ranged from Sept. 18, 2017, to Sept. 17, 2019; new dates range from Jan. 28, 2019, to Jan. 26, 2021)

- The compliance dates for 21 CFR part 507 for facilities solely engaged in the ginning of cotton are being extended by approximately 16 months (original dates ranged from Sept. 18, 2017, to Sept. 17, 2019; new dates range from Jan. 28, 2019, to Jan. 26, 2021)

- The compliance date for importers to have FSVPs for imported food contact substances that meet the definition of food is being extended from May 30, 2017, to May 28, 2019.
