Japan Targets U.S. Bearings, Steel for Additional 17.4% Tariffs in Trade Dispute

Japan announced recently that it will drastically expand the sanctions it imposes against exports of U.S. products in retaliation for the continued distribution of antidumping and countervailing duty revenues to affected U.S. producers under the Continued Dumping and Subsidization Offset Act, or Byrd Amendment. The level of these sanctions is dependent on the amount of revenues collected from imports of Japanese products subject to AD or CV duty orders that were distributed in the previous year, which jumped from $1.96 million to $103.43 million in fiscal year 2012. The value of U.S. exports targeted by Japan will therefore balloon from $1.41 million to $74.47 million.

Accordingly, for the period Sept, 1, 2013, through Aug. 31, 2014, Japan will impose an additional 17.4% duty on imports of the following U.S. goods, which are listed by the nine-digit classification found in the Harmonized Tariff Schedule of Japan.

7222.11.000 – bars and rods of stainless steel (not further worked than hot-rolled, hot-drawn or extruded) (of circular cross-section)

7222.20.000 – bars and rods of stainless steel (not further worked than cold-formed or cold-finished)

7222.30.000 – bars and rods of stainless steel (not covered by nos. 7221.00.000–7222.20.000)

7304.59.020 – tubes, pipes and hollow profiles, seamless, of iron (other than cast iron) or steel (not covered by nos.7304.11.000–7304.49.020) (of circular cross-section, of other alloy steel)

(excluding those of cold-drawn or cold-rolled (cold-reduced)) (excluding drill pipe)

8482.10.000 – ball bearings

8482.20.000 – tapered roller bearings, including cone and tapered roller assemblies

8482.40.000 – needle roller bearings

8482.50.000 – cylindrical roller bearings (excluding those of spherical or needle)

8482.80.000 – roller bearings, including combined ball/roller bearings (excluding those of tapered, spherical, needle or other cylindrical)

8482.91.000 – parts of ball or roller bearings: balls, needles and rollers

8482.99.000 – parts of ball or roller bearings (excluding balls, needles and rollers)

8483.30.010 – bearing housings, not incorporating ball or roller bearings; plain shaft bearings (for motor vehicles)

8483.30.090 – bearing housings, not incorporating ball or roller bearings; plain shaft bearings (not for motor vehicles)

During the previous annual period, the only product subject to retaliatory measures by Japan was tapered roller bearings (8482.20.000), which was assessed an additional 4% duty.
