IPR Enforcement Actions on ATMs, Nursing Bras, Audio Processing Equipment

ATMs. The International Trade Commission has instituted investigation 337-TA-989 to determine whether imports of automated teller machines, ATM modules, components thereof, and products containing the same are violating Section 337 of the 1930 Tariff Act by reason of patent infringement. The products at issue include deposit automation modules, cash handling modules and cassettes therefor.

Complainants Nautilus Hyosung Inc. and Nautilus Hyosung America Inc. request that after this investigation the ITC issue a limited exclusion order, which would direct U.S. Customs and Border Protection to prohibit the entry of infringing products into the U.S., and cease and desist orders, which would require the named respondents to cease actions that violate Section 337, including selling infringing imported articles out of U.S. inventory. The respondents in this investigation are located in the U.S.

Pumping Bras. The ITC has instituted investigation 337-TA-988 to determine whether imports of pumping bras are violating Section 337 of the 1930 Tariff Act by reason of patent infringement. The products at issue are nursing bras that allow for hands-free pumping.

Complainant Simple Wishes LLC requests that after this investigation the ITC issue a general exclusion order or limited exclusion order, which would direct CBP to prohibit the entry of infringing products into the U.S., and a cease and desist order, which would require the named respondents to cease actions that violate Section 337, including selling infringing imported articles out of U.S. inventory. The respondents in this investigation are located in China.

Audio Processing Equipment. The ITC has terminated patent infringement investigation 337-TA-949 of audio processing hardware and software and products containing same with respect to two respondents on the basis of a settlement agreement and patent license agreement with complainant Andrea Electronics Corp.
