Form to Designate Process Agents for Motor Carriers and Freight Forwarders Under Review

The Department of Transportation’s Federal Motor Carrier Safety Administration is requesting comments no later than Jan. 30, 2012, on form BOC-3, “Designation of Agents for Service of Process.” Registered motor carriers (including private carriers), brokers and freight forwarders are required to designate an agent on whom service of notices in proceedings before DOT may be made. Registered motor carriers must also designate for every state in which they operate and traverse in the U.S. during such operations an agent on whom process issued by a court may be served in actions brought against the registered transportation entity. In addition, brokers must make a designation for each state in which their offices are located or in which contracts are written. Subsequent filings are made only if the carrier, broker or forwarder changes process agents.
