Request Filed for NAFTA Review of Mexican CV Duties on U.S. Stearic Acid. The International Trade Administration has announced that a Mexican company has filed a first request for a panel review with the Mexican section of the NAFTA Secretariat pursuant to Article 1904 of the North American Free Trade Agreement. The company is requesting a review of the final determination of the effective examination and official review on CV duties regarding imports of certain U.S. stearic acid classified under HTSMX 3823.11.01 and 3823.19.9901.

Chapter 19 of the NAFTA establishes a mechanism to replace domestic judicial review of final determinations in AD and CV duty cases involving imports from a NAFTA country with review by independent bi-national panels. When a request for a panel review is filed, a panel is established to act in place of national courts to review expeditiously the final determination to determine whether it conforms with the AD or CV duty law of the country that made the determination.
