New FDA Reinspection and Recall Fees Get Extended Comment Period

The Food and Drug Administration is extending from Oct. 31 to Nov. 30 the deadline for public comments on new user fees it is imposing for fiscal year 2012, which began Oct. 1. These comments will not affect the fees assessed in FY 2012 but will, along with experience and additional data gained in implementing the fees, be used in establishing the fee rates for FY 2013.

Pursuant to the FDA Food Safety Modernization Act, the FDA has established new fees to cover the costs of domestic and foreign facility reinspections, noncompliance with recall orders and importer reinspections. These fees will be assessed at the rates of $224 per hour or $325 per hour if foreign travel is required. Click here for more information on these fees.
