MELISSA MILLER PROCTOR is a Member with Sandler, Travis & Rosenberg, P.A., and leads its Export Practice Group. Based in Orange County, Calif., Ms. Proctor has more than 13 years’ experience advising importers and exporters on various issues involving compliance with U.S. laws and regulations as well as the import laws and regulations of other countries.
Ms. Proctor conducts internal compliance reviews of import operations and drafts customs compliance and procedures manuals; handles valuation, classification and country of origin/marking issues; provides guidance on the eligibility and documentary requirements of the various U.S. preferential trade programs and free trade agreements (e.g., NAFTA, HTSUS 9801 and 9802, GSP, AGOA, CBTPA, ATPDEA, DR-CAFTA, etc.); represents clients during quick response audits and focused assessments; and assists clients in the filing of prior disclosures as well as responses to government inquiries, claims of liquidated damages and penalty actions. She advises on issues involving 10+2, the Lacey Act, CPSIA, and state-driven regulatory measures that impact importing activities (e.g., California’s Proposition 65, AB 1108 and the Air Toxic Control Measure regulations). She also advises U.S. clients on the import requirements of other countries.
With respect to exports, Ms. Proctor provides advice on the regulatory requirements applicable to the export and re-export of dual-use commodities, technology and software (including encryption) under the Export Administration Regulations as well as defense articles, services and technical data subject to the International Traffic in Arms Regulations. She also counsels clients on the various embargo and sanctions programs administered by the Treasury Department’s Office of Foreign Assets Control. She routinely assists clients in the preparation and submission of commodity jurisdiction requests and ITAR license applications, obtains commodity classification determinations and licenses from the BIS under the EAR, conducts internal export compliance reviews, creates export compliance manuals and desktop procedures for companies, and assists clients in handling voluntary self-disclosures, seizures by U.S. Customs and Border Protection and responses to government charges of potential export violations. She also advises U.S. clients on the export requirements of other countries.
Before joining the Firm, Ms. Proctor was engaged in private practice with a law firm in Chicago and a Big Four accounting and consulting firm in California, focusing on the areas of export control regulation, import regulation and antidumping/countervailing duties. |
